Terms of Use & Disclaimer
Monium (the “Application”) is an educational tool for exploring superconducting-qubit physics (Transmon, Tunable Transmon, and Fluxonium), provided by nurmelleben (the “Developer”). By downloading or using the Application you agree to these Terms of Use. If you do not agree, do not use the Application.
Your purchase and the app stores
The Application is distributed through the Apple App Store and Google Play. Your purchase, download, and payment are governed by the terms of the respective store, which is the seller of record; questions of price, billing, refunds, and any statutory right of withdrawal are handled by that store under its own terms. These Terms of Use govern only your use of the Application itself and do not replace the store’s terms.
Educational and informational use
The Application and all data, calculations, and results it produces (the “Output”) are provided for educational and informational purposes only. While the Application’s physics is validated against the open-source scqubits library, the Output may nonetheless contain errors or inaccuracies.
Disclaimer of warranties
THE APPLICATION AND ALL OUTPUT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, THE DEVELOPER DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APPLICATION OR THE OUTPUT WILL BE ACCURATE, ERROR-FREE, COMPLETE, OR UNINTERRUPTED.
No reliance
The Output is not a substitute for independent professional judgment or verification. You are solely responsible for verifying the accuracy and suitability of the Output before relying on it, and you assume all risk arising from any use of, or reliance on, the Application or the Output. The Application is not intended for use in any safety-critical, clinical, medical, or other context in which an error could result in death, personal injury, or property or financial damage.
Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL THE DEVELOPER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE APPLICATION OR THE OUTPUT, UNDER ANY THEORY OF LIABILITY, EVEN IF THE DEVELOPER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE DEVELOPER’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE APPLICATION WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APPLICATION OR USD $10.
Exceptions
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities (including, in some places, incidental or consequential damages), so some of the above exclusions and limitations may not apply to you. Nothing in these Terms limits any liability that cannot be excluded or limited under applicable law, and any mandatory consumer rights you have under the law of your country of residence remain unaffected.
Governing law
These Terms are governed by the laws of the State of Illinois, USA, and applicable U.S. federal law, without regard to conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Severability
If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Changes
These Terms may be updated from time to time. The current version will be posted at this URL with a new “last updated” date; continued use of the Application after a change constitutes acceptance of the revised Terms.
